THE ARTWORK

Artwork:       6 x Fibreglass Cows as described in Annexure 1

Artist:           Various local artists as described in Annexure 1

Description of Artwork:  The 6 fibreglass cows have been painted by local artists as part of the Carnival of Flowers/Grand Central Floral Parade as described in the Annexure 1

The successful bid for each Artwork from the silent auction will be donated to the selected artist’s charity as described in Annexure 1.

The Artwork will be on display in the Centre from  22 September 2019-  13 October 2019.

Auction Period:

Auction Open: Sunday 22 September 2019 at 9am Auction Close: Monday 14 October 2019 at 10am

How to place a bid:  To participate in the Silent Auction the Bidder must be an Eligible Person who registers and places a valid bid (above any reserve price set) for an Artwork via the online bidding form on  Galabid (https://app.galabid.com/cows/items) during the Auction Period (Eligible Entry)

Collection of Artwork: The Artwork must be collected by the successful Purchaser from  Grand Central Shopping Centre between Tuesday 15 October 2019 and Wednesday 6 November 2019 (or such later date first agreed by QIC)  at a time and location as agreed by QIC.

1. A Bidder must be an individual who:

1. is a resident of Australia;

2. over the age of 18 years of age; and

3. submits an Eligible Entry.

1. The outcome of the Auction final. All Artworks are on an “as is” Basis.   QIC and the Centre has attempted to describe and catalogue Artworks correctly, but neither warrants nor represents and in no event shall be responsible for the correctness of descriptions, genuineness, authorship, provenance or condition of the items. No statement made in this auction or elsewhere, shall be deemed such a warranty, representation, or assumption of liability.

2. The Artworks are not transferable, refundable or exchangeable and cannot be taken as cash.

3. The highest Bidder for each Artwork at the end of the Auction Period (and above any reserve price set by QIC) will be taken to be the successful bidder (the ‘Purchaser’) and will be taken to have entered into a binding contract for the purchase of the Artwork from the Centre on these terms and conditions. QIC will use reasonable efforts to notify the Purchaser via telephone or email with instructions to arrange payment of the successful bid to the charity and collection of the Artwork.  The Purchaser must show the paid receipt to the relevant charity no later than 7 days from being notified as the Purchaser, before the Artwork can be collected.

4. If despite reasonable efforts QIC is unable to locate or contact a Purchaser within 2 weeks after the Auction Period or the Purchaser fails to make payment of the bid to the charity, the Artwork will be forfeited and QIC may (in its absolute discretion) offer the Artwork for sale to the next highest bidder until the Artwork is sold.  All Artworks remain the property of QIC until the Purchaser has made payment for the Artwork in full and funds have been cleared.

5. When the Purchaser collects the Artwork, QIC may coordinate the Purchaser to attend a photoshoot with the Artwork and therefore the Purchaser will be required to provide consent to be photographed and named on social media for the Centre.

6. In the event of any disputes, the final decision rests with QIC.

7. Each Bidder assumes all risks and expenses related to the Auction. 

8. QIC and the Centre shall not be liable (including, without limitation, in negligence) for:

1. any loss or damage whatsoever that is suffered (including, but not limited to, indirect or consequential loss); or

2. any personal injury suffered or sustained,

   during the course of participating in this Auction or using the Artwork, except for and to the extent that any liability cannot be excluded by law.

1. Each Bidder and Purchaser indemnifies and keeps indemnified QIC against all claims, losses, damages, costs and expenses suffered or incurred by the QIC or any third parties arising out of the breach of these Terms and Conditions, the conduct of the Bidder in the Auction or the use of the Artwork.

2. If this Auction is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of QIC or the Centre, QIC reserves the right, in its sole discretion, to the fullest extent permitted by law and subject to any written directions from a regulatory authority (if any) to:

1. disqualify any Bidder; and/or

2. modify, suspend, terminate or cancel the Auction as appropriate.

1. QIC reserves the right, at any time, to verify the eligibility of any Bidder and to disqualify any Bidder who does not comply strictly with these Terms and Conditions or who tampers with the Auction process.  Failure by QIC to enforce any of its rights at any stage does not constitute a waiver of those rights.

1. Under the Privacy Act 1998 (Cth), QIC must notify Bidders of certain matters when it collects personal information about them including how it plans to use or disclose it.  If a Bidder chooses to enter or take part in the Auction, the Bidder may be required to provide QIC with personal information about themselves such as the Bidder’s full name, address, email.

2. QIC will collect, use and disclose the personal information which the Bidder has provided the following purpose:

1. of carrying out the Auction (for notification and promotion of Artwork); and

2. adding the Bidder’s details to the Centre’s database.

3. By entering the Auction or registering as a Bidder, the Bidder consents to the collection, use and disclosure of his or her personal information in the manner outlined in these Terms and Conditions.

4. If a Bidder would prefer that QIC does not use or disclose the Bidder’s personal information in the way outlined in these Terms and Conditions and/or retain their personal information for the     purposes described herein, the Bidder should contact QIC on (07) 4632 5866.

5. A Bidder has the right to access, in most circumstances, personal information which QIC holds about the Bidder.  A Bidder may contact QIC on (07) 4632 5866  to ask for access to the     Bidder’s personal information, or if the Bidder has a complaint concerning a Bidder’s information privacy.  QIC may deny the Bidder’s request for access in some circumstances.  If QIC does this, it will tell the Bidder why.

6. QIC's Privacy Policy contains further information on its processes in relation to access to and correction of personal information, about how a Bidder may complain about a breach of the Australian Privacy Principles and how QIC will deal with such a complaint. QIC's Privacy Policy is available at www.grandcentralshopping.com.au.

7. If a Bidder considers that any personal information that QIC holds about the Bidder is inaccurate or if at any time the Bidder’s details change, the Bidder may contact QIC on (07) 4632 5866 and QIC will take reasonable steps to ensure that such personal information is corrected.  QIC will take reasonable steps to keep personal information secure from misuse, interference, loss or unauthorised access, modification or disclosure.

   Artists & their chosen charities

Joy Heylen & Drought Angels

Artist:  Joy Heylen found her purpose and identity for being in sculpture.  The design for her cow drew on symbolic interpretation from the floral spray pattern of a paisley motif, which is a symbol of life and eternity.

Charity:  Drought Angels is committed to providing heartfelt, discrete and personalised support to farmers and their rural communities.  They provide direct and timely financial assistance, essential resources and meaningful relief for primary producers impacted by drought and natural disasters.  The majority of their support is given in the form of prepaid visa cards.  They understand that these hard working people are proud and often struggle to ask for assistance of any kind.  The cards have no markings on them and can be used to pay for groceries, utilities or stock feed.  This gives farmers some control over their situation where they have no control over mother nature.    

Mary-Kate Thomson and Lifeline Darling Downs and South West Queensland

Artist:  Mary-Kate Thomson is a graphic designer / illustrator who grew up in Toowoomba and returned to the city to raise her family.  The inspiration for her violet and wattle cow design is the beautiful flora of the Garden City, and the focus is the historically significant and iconic Toowoomba Violet.  Many violet posies were sold post-war to fund the Mother’s Memorial.  Wattle, a native flower, perfectly complements the non-native violet.

Charity:  Lifeline Darling Downs and South West Queensland is a local community based organisation which offers a range of crisis support and community services.  They provide 26 human services across Toowoomba and the Darling Downs to a population in excess of 260,000.  Their services include, but are not limited to, family and individual counselling, emergency relief and suicide prevention.  Lifeline assists the most vulnerable members of our society when they are in distress and services are free to all those who need them.  The funds raised from the silent auction will be used to support their self-funded free, confidential counselling service which is available to anyone who needs it. 

Anna Bartlett & Hope Horizons

Artist:  Anna Bartlett is a contemporary painter whose mission is to share the joy of drawing and painting.  Happy colours are her ‘thing’ and she says flowers are a fantastic way to explore colour.  The ‘Graphic Floral Cow’ she painted for Grand Central is a bold, clean, graphic depiction of stylised floral motifs.

Charity:  Hope Horizons supports all cancers with a Cancer Wellness Centre in Toowoomba.  They strive to enhance the quality of life of all people affected by any cancer within Toowoomba and the Darling Downs region throughout and after their cancer diagnosis, encouraging empowerment through education and awareness. Their clients can expect a welcoming atmosphere with a genuine focus on individual care, where a variety of support services are delivered with professionalism, integrity and confidentiality.

Kym Breeze & Emerge

Artist:  Kym Breeze has exhibited at various galleries in Toowoomba, Sydney and surrounding regional areas, and has also sold some works internationally.  The main influence of her art has always been colour and texture.  For her cow, she drew on her earliest memories of Carnival as a child, and the tradition she started with her own children as they grew up – celebrating all the beauty of our city each year as Carnival came around.  Family embraced by the flower, blue skies, green rolling hills and happiness.

Charity:  Emerge is a youth organisation and social enterprise cafe engaging and empowering youth in the Toowoomba community. They bring together a dedicated youth space, a fully operational cafe and cooking school, crisis resources and boxing and fitness programs for youth in the Toowoomba region who are experiencing hardship such as homelessness, social disadvantage, poverty and racial exclusion.

Jennifer Wright (Summers) & Sunrise Way

Artist:  Jennifer Wright (Summers) is a well-known Toowoomba artist and Arts advocate.  She embraced a ‘walk back in history’ theme for her design.  Each patch of history shows times on this place such as the volcanoes that made our soil rich, the First People going to a Bunya Festival, colonial pioneers, and the long history of where Grand Central now stands.

Charity:  Sunrise Way is supporting stronger and healthier communities in regional and rural Queensland through helping individuals living with addiction to rebuild their lives.  It is a 20 bed not-for-profit rehabilitation service based in Toowoomba that facilitates a 26 week program.  The goal of the program is to enable clients to understand their addiction, manage their mental health, develop skills and strategies to maintain sobriety, and rebuild their lives.

Katie Whyte & RSPCA Queensland

Artist:  Katie Whyte is an abstract painter living in Toowoomba.  She wanted to create a design that was reflective of Spring time in Toowoomba and how the Carnival has helped shape our local identity over time. Katie took two quintessential Toowoomba elements and combined them to form the design – the shape of the horizon over the Toowoomba Range and the outline of flowers in bloom.

Charity:  RSPCA Queensland is a non-government, community based charity dedicated to protecting the welfare of all animals – great and small.  Their Toowoomba Animal Care Centre’s facilities are long overdue for an upgrade, so they’re currently in the process of building a new adoption centre near Toowoomba Wellcamp Airport.  Any funds raised from the auction will be allocated to the fit-out of this adoption centre.
